TEXARKANA, Ark. -- Arkansas State Police Investigators will prepare an investigative file on Wednesday's officer-involved shooting at Zapata's Restaurant that will be submitted to the Miller County prosecuting attorney.

The prosecutor will review the statements and evidence contained in the file and determine whether the use of deadly force by a law enforcement officer was consist with Arkansas laws, said Bill Sadler, spokesman for ASP.

A man in the restaurant was shot about 7:30 p.m. Wednesday by an off-duty Texarkana police officer. The off-duty Texarkana Arkansas Police Department officer was inside Zapata's when he allegedly "encountered a subject committing a felony crime," according to TAPD. The incident resulted in the officer shooting the suspect.

The man was taken by ambulance to a local hospital. His injury is not considered to be life-threatening, according to officials. Neither the suspect's name or the name of the officer involved have been released by officials.

Information on the suspect's charges has also not been released.

Additional information on the incident will come from ASP, TAPD Cpl. Kelly Pilgreen said Thursday.

Zapata's Restaurant is located at 217 Walnut St., downtown. Numerous people were inside the restaurant when the shooting occurred.
