TEXARKANA, Texas -- A Texarkana man accused of sexual misconduct with a 12-year-old allegedly ran shirtless and barefoot when confronted with the allegation.

Michael Montreal Lindley, 23, was allegedly staying at the Texarkana, Texas, home of a woman he was dating when she woke to find he was not there around 11 p.m. Dec. 19, according to a probable cause affidavit. After hearing the woman call his name, Lindley allegedly came to the bedroom door and claimed he was making coffee.

Suspicious because there were no lights on in the kitchen, the woman allegedly found the 12-year-old girl on the floor of her bedroom with her "pants and underwear down at her knees," the affidavit states. When confronted, Lindley allegedly fled from the house barefoot and shirtless.

The girl allegedly reported that she was asleep when Lindley woke her by shaking her leg. Lindley allegedly got the girl out of bed and onto the floor where he allegedly pulled her bottoms and underwear down. When Lindley heard the woman in the house calling his name, he allegedly told the girl he would kill her if she told.

"Officers searched for Lindley but were unable to locate him," the affidavit states. "Lindley later returned to the residence but fled from officers into the woods."

Bowie County records show Lindley was booked into the Bowie County jail Tuesday and has not been released. Bail is set at $75,000.

If convicted of indecency with a child by exposure, Lindley faces two to 10 years in prison. The case has been assigned to 5th District Judge Bill Miller.
